Back off our Land – Bat Valley Company owners, drag Ntaganda to Museveni

Owners for Bat Valley Bar and Restaurant Company Limited have moved to petition president Yoweri Kaguta Museveni seeking his intervention against what they call impunity by the city businessman Ephraim Ntaganda.

The move follows fraudulent transfer of their land title on plot 2- Semuliki -Walk, LRV 4464, Folio 23, in Nakasero III Parish-Kampala Central Urban Council around Kisseka market into the names of Buko Oil Investments Limited, in disregard of an interim Court order that was issued restraining Ntaganda and any other party from doing anything on the property until the case has been disposed of.

The order had been issued by the High Court Registrar Simon Zirintuusa arising from an application filed by the company owners in which they were accusing Ntaganda of grabbing their property fronting one Ivan Byaruhanga, when he stormed the premises in the night of the Sunday 29th last month under heavy security and demolished the structures housing the Bar and Restaurant after over powering the private security personnel protecting it.

The plaintiff had convinced Court as bonafide occupants under a lease arrangement sanctioned by the KDLB continuing up to 2025 since 1994, forming basis for an order maintaining the status quo. But Ntaganda through his lawyers also told Court in defense that he had also secured a lease from the same body.

The plaintiff had also joined KDLB and the Commissioner for Land Registration, as parties in the case, accusing them of conniving with the grabbers to deprive her of her property rights.

Now Hema Damani has told this Website that the transfer of the disputed land at the expense of a standing Court order is impunity that can only be cured by the president.

“These grabbers have already proved to be un ethical and above the law, because they have broken the status quo and transferred the land in less than four days” Damani said at the side lines of the Court session.

The visibly angry hotel female investor explained that they were petitioning the president because Ntaganda, Buko and the District Land Board were proving to be un touchable. “The minister of Lands has already written a letter asking for investigations, that has been disregarded”

Damani who questioned the motive behind the rush for transfers, wondered why another letter from the State House which was calling for investigations into circumstances under which the lease was terminated in line with documents, was disregarded.

The purpose of the said letter was to move the District Land Board Secretary provide a report on how the termination of the lease occurred and thereafter a date be communicated with all stake holders in the meeting to adjudicate matters before the end of this month.

However, the acting District Land Board Secretary Mr. Emmy Waliggo declined to provide a response when approached by this news site, saying it was the chairperson Mr. David Balondemu who was authorized to address the media. But the last time when we contacted the chairperson he referred us to the Secretary whom he said was privy to  all the necessary information concerning the said property.
