M/s Muljibhai Madhivani and Company Limited is on spot for alleged secretly selling of land at Nakigalala and Kansiri Estates in Wakiso District to the government, whose ownership is still subject to a court process.
It is alleged that the Madhivani and Company Limited is secretly engaged in the sale of the land to the government through the Ministry of Science, Technology and Information in disregard of the ongoing court cases against them.
“Our clients do not object to the implementation of any government project. We are instructed by our clients to inform you that our clients do not object to any project that the government may wish to implement upon the land at Nakigalala and Kansiri. However, they oppose the payment to Muljibhai Madhivani whose ownership is highly questionable in view of the fraudulent acquisition that has been demonstrated in detail in pleadings before court,” reads a petition dated September 18, 2016.
Documents show that Madhivani and Company is a defendant in the case filed by the family of Muwanga Omuwesi over ownership of more than 306 acres at Nakigalala; Madhivani is also complainant against the administrators of the estate of the late Muwanga Omuwesi and also a party in the case filed by the administrators of the estate of the late Daudi Chwa in Civil suit number 0158 of 2026; all pending before the High Court in Entebbe
According to the petition, it is in bad faith and possibly fraudulent for the Attorney General who is the first accused party to proceed with the transaction while a court case is pending.
“This duty of care that your office owes to the government would be violated by the advice to proceed while fully knowing that there is pending court and that the Madhivani title to FRV 45 folio 2 out of which later plots were divided is tainted or at the least highly questionable,” reads the petition.
The family of the Late Sir Daudi Chwa petitioned the Attorney General (AG) Sam Mayanja in a letter dated ‘further evidence on ownership of 945.15 acres of land at Nakigalala and Kansiri by the Estate of Daud Chwa and urgent caution to desist from paying for land before ownership is verified’.
Through their lawyers of TFB Advocates and Legal Consultants, the family states that they have since secured documents that have not been previously been in court; among them the Title Deed for FRV 4 folio 2 registered on August 9,1932 in the names of Uganda Rubber & Coffee Limited of Nsimbe Estates , Mawokota, Uganda; the lease agreement dated December 12, 1930 made between Kabaka Daudi Chwa of Mengo out of his private mailo under PC 9995 and FC 10008at Nakigalala and Kansiri as Lessor to the Uganda Rubber and Coffee Estates Limited as lesse for 82 years at a consideration of Shs1,083,516; an application dated August 2,1032 by Uganda Rubber and Coffee Estates Limited to bring the 945.15 acres of land at Nakigalala and Kansiri under Registration of Titles Ordinance of 1908 and Form DAPCB VII – a letter dated September 24 1992 from the Departed Asian Property Custodian Board to the Chief Registrar of Titles.
According to petition, in 1993 the Departed Asians’ Property Custodian Board wrote to the Chief Registrar of Titles in the Ministry of Lands indicating that the registered proprietor appearing for land FRV 4 folio 2 is Uganda Rubber and Coffee Estate Limited and not M/s Muljibhai Madhivani and Company Limited.
“It is therefore in accordance with the law to inform you that the repossession certificate dated March 6,1991 in respect of 945.15 acres under FRV4 folio 2 at Nakigalala Tea Estates issued in names of M/s Muljibhai Madhivani and Company is not effective from the date of this letter,” reads the letter signed by then Minister of state for finance.
Last month, Entebbe High Court presided over by Assistant Registrar Rashida Butanula inspected the disputed 306 acre portion comprising housing structures and crops as well as some of the family members and administrators of the estate of the late Muwanga Omuweesi.
While on the fact finding mission, the Registrar, Ms Butanula interviewed several stakeholders among them the local council leaders at Nakigalala Cell, family members occupying and cultivating part of the land as well as managers from Madhivani group Limited.
The Administrators of the late Muwanga Omuweesi; Benjamin Kalumba Ssebuliba and Robert Kayongo are embroiled in a protracted legal battle for ownership of the land on Block 374 measuring 306 acres.
Madhvani Group Limited is in court over accusations of grabbing the land and fraudulently changing its tenure from Mailo land to freehold to deprive the family of the deceased Buganda chief of their interest.
The company is jointly accused with its subsidiary; Kakira Sugar Works Limited and the Commissioner for Land registration in the case that has spanned over more than a decade in the court system since 2013.
In 2022, the Land Division of the High Court issued a temporary Order restraining the agents, workers and employees of Madhavani group limited from claiming, selling alienating, and or mortgaging the land at Nakigalala, Kajjansi in Wakiso district until determination of the pending case.
