Mengo chief Magistrate Esther Rebecca Nasambu has on Thursday afternoon dismissed with costs National Unity Platform NUP’ Fred Nyanzi application for vote recount for Kampala central constituency.
Nyanzi filed the application challenging the victory of the incumbent Hon. Muhammad Nsereko for Kampala central Member of Parliament.
On Wednesday, court heard submissions from lawyers of Nyanzi, Electoral Commission (EC) and Muhammad Nsereko, who was declared the winner of the elections.
Court records indicate that Nsereko polled 16, 998 while Nyanzi emerged second with 15,975 votes.
In his application, Nyanzi claims that the voting and counting exercise was marred by electoral malpractices and irregularities such as alteration of the declaration forms by Nsereko and the Electoral Commission
However Nyanzi’s claims were refuted by Nsereko and EC lawyers saying they are not backed up with evidence.
