First Suspect In Kayanja Sodomy Case Fears to testify under Oath as Defense Begins.

The Mwanga II Magistrates’ Court Mengo Kampala on Monday issued an arrest warrants for Patrick Ayebare, Abdul Kayondo, and Tracy Namugga,  who had stood as sureties for Moses Tumwine, one of nine youths accused of falsely accusing Pastor Robert Kayanja of sodomy from Miracle Centre Cathedral Rubaga.

The warrants were issued on Monday by Senior Principal Grade One Magistrate Adams Byarugaba, after a request by Chief State Attorney Jonathan Muwaganya, noting the sureties’ failure to produce Tumwine for trial as ordered. Byarugaba granted the requests ordering that the trial proceed in Tumwine’s absence and ordering the remaining co-accused to defend themselves against charges of trespassing at Rubaga Miracle Cathedral with intent to annoy Pastor Kayanja.

On 25th/04/2025, the same Court issued a warrant of arrest against Moses Tumwine, one of the accused persons in the case in which nine people are accused of giving false information to police, accusing Miracle Centre Cathedral’s leader Pastor Robert Kayanja of Sodomy.This followed Moses Tumwiine for absconding the court proceedings for three times and also issued summons to sureties of Moses Tumwine to appear before court to explain why they shouldn’t be ordered to forfeit the bail bond they committed to paying in case he runs away from the trial.

The other accused are Peter Serugo, Reagan Ssentongo, Moses Tumwine, Khalifa Labeeb, Alex Wakamala, Martins Kagolo, Israel Wasswa, Jamil Mwanda, and Aggrey Kinene 

They are also charged with conspiracy to defeat justice, committing a felony, criminal trespass, and giving false information to the police. It is alleged that Serugo, Ssentongo, Khalifa, Wakamala, and Kagoro, while employed as police officers, intentionally gave false information to Detective IP Cotilda Nandutu, falsely claiming that Pastor Kayanja had committed unnatural offenses against them.

In earlier testimony in October 2024, Pastor Robert Kayanja told the court that the nine individuals had falsely accused him of sodomy. He alleged a conspiracy to frame him.

Now, even the best laid plans can go awry and this seems to be the case of the well orchestrated sodomy allegations against Pastor Robert Kayanja. As the first of the nine suspects began their defense, one would clearly tell that he was memorizing from a coached script little knowing that all we come tumbling down like a pack of cards.

As Martin Kagoro began his defense on Monday he refused to testify under oath, one wonders that if really he is sure that his testimony is the truth then why fear to give it under oath and later face a cross examination. As he testified he narrated how he was allegedly sodomized and later paid and as he did so he shed tears albeit crocodile ones.

One wonders why he didn’t put all that in his statement before police and why his lawyers did cross examine Pastor Kayanja to the fact when he was in court. Kagoro went on to say that he made no statement at police but then shot himself by saying he got bond and bail. Surely can one get a police bond having not written a statement? 

Back to his defense that he was sodomized, a doctor of their choice Sam Kalungi, a police doctor testified before Court and under oath that none of the suspects had been sodomized.

The case was adjourned on 09th /05/2025, for further hearings and testimonies.
