UPC Calls For Immediate Release of Civilians Charged in Court Martial

 The Uganda People’s Congress (UPC) Party has called for the immediate release of individuals being held illegally in prison on charges in military court martial, following a landmark Supreme Court ruling that declared the trial of civilians in military courts unconstitutional.

Faizo Muzeyi, the UPC’s head of media and communications, welcomed the ruling in the case of Attorney General vs. Hon. Michael Kabaziguruka, issued on January 31, 2025, after a prolonged four-year wait. The decision, which bars civilians from being tried in military courts, is seen as a major victory for democracy, the rule of law, and human rights.

In a statement, Muzeyi emphasized that although the ruling came late, it signifies the triumph of citizens’ efforts to safeguard democratic principles, governance, accountability, and constitutionalism. “The decision restores hope in Uganda’s judiciary and strengthens the commitment to human rights and justice,” Muzeyi remarked.

The UPC has particularly called for the release of opposition figures Dr. Kiiza Besigye and Obed Lutale, both of whom are currently being held without legal grounds.

Muzeyi referenced Article 92 of Uganda’s Constitution, which prohibits Parliament from passing laws that contradict court rulings. He urged the Attorney General, Kiryorwa Kiwanuka, to respect the Supreme Court decision and refrain from introducing amendments to the UPDF Act that could undermine the ruling.

“The executive must view this decision as an opportunity for reform, ensuring the protection of human rights, the rule of law, and constitutional integrity,” Muzeyi concluded.
