Inspectorate of Courts Rejects Bias Claims Against Chief Magistrate Kayizzi, Lawyers to Face Criminal Trial

The Inspector of Courts have exonerated Buganda Road Chief Magistrate, Ronald Kayizzi of any wrong doing in the decision that sanctioned charges of alleged forgery and uttering a false document.

In August 2024, Kayizzi sanctioned criminal charges against city lawyers Robert Ssenfuka and Umar Nyanzi directed them to appear and stand trial.

However, the accused lawyers complained to the Inspectorate of Courts that they said Kayizzi was personally known to the complainant Pastor Daniel Walugembe.

They accused Kayizzi of being biased and abusing judicial authority. 

In a January 6, 2025 letter to the Chief Registrar, Hellen Ajio, and the Deputy Registrar at the Inspectorate of Courts found that Kayizzi while still in private practice, represented the party in a case where Pastor Walugembe was an adverse party in the case.

“Considering that Kayizzi was not representing Pastor Walugembe at the time, I do not see any conflict of interest to warrant him being penalized. Had Kayizzi been biased, he would not have been admitted the private institution. This allegation is thus false” held  Ajio adding that Kayizzi duly executed his duties in this matter with due diligence.

As regards the criminal case, Ajio said that the inspectorate had the opportunity to see the record of proceedings where the chief magistrate subjected the matter to a trial in accordance with decided cases.

“Unfortunately, instead of the suspects appearing in court to take plea, they have resorted to writing different letters accusing the chief magistrate of bias and abuse of judicial authority. I think this is intended to intimidate the judicial officer, which is unfortunate,” reads the letter.

The accused lawyers are accused of uttering false documents and conspiracy to commit a felony and forgery of land sale agreements for sale of Kibanja in Katanga near Wandegeya.

It is alleged that the lawyers Senfuka and Nyanzi practising with SK & Partners Advocates while acting for and on behalf of their client, Dr Ntwatwa Lule committed criminal acts.

Court documents indicate that the accused lawyers are alleged to have committed forgery, uttering false documents and conspired to commit a felony when knowingly and unlawfully altered sales agreements dated February 9,1996 and August 13, 1996 respectively.

In the complaint filed by private prosecution, Walugembe, the accused lawyers allegedly forged the said sales agreements to alter original and authentic agreements drawn by the parties when the complainant was purchasing his Kibanja on Katanga land in 1996.

According to court records, Ssenfuka and Nyanzi forged Walugembe’s agreement of February 9, 1996 and that August 13 1996 to indicate MTN telephone numbers of him (Walugembe) and his lawyer as well as bearing Land Act Cap 227 as the law under which the agreement was executed in 1996 yet it did not exist but alter the authentic agreements acquired by Walugembe.

The complaint further states that the genuine and authentic sales agreements bore a certificate of translation whereas the forged ones did not.

Walugembe contends that the said forged agreements originated on behalf of Dr Ntwatwa thereby committing the offence of conspiracy to commit a felony before they were uttered before the Magistrates Court at LDC on July 10 2023 while cross examining him.
